- Multiple health conditions and not ready to return to work: Claimants that are not ready to return to work should speak to their treating doctor. Only a claimant’s medical team can decide when a claimant is ready for work and the possible restrictions and accommodations required. Individuals that are pressured to return to work by their employer or the insurer should seek immediate legal advice.
- Definition of own occupation period: Claimants in the first two years of long-term disability have to be able to prove that they are unable to work in their own occupation due to their disability. After two years on LTD, the test in order to qualify under most disability policies changes. After two years, a claimant has to prove that they are disabled from working in any occupation that they have an appropriate skillset for.
- A claimant with lung disease for several years on LTD: Claimants who have been on long-term disability for over two years have been able to prove that their disability prevents them from working in any occupation. A re-evaluation of a claim after several years is confusing and can cause confusion for claimants. It is important for claimants to understand their rights if they continue to receive the support of their doctor.
- Severe injury after an accident: Individuals that have sustained a serious injury as a result of a car accident can be eligible for compensation. Claimants in Alberta can seek the advice of a disability lawyer in order to determine further damages and potential income loss benefits.
