- Repeated failed appeals lead to the expiry of the limitation period: It is essential before appealing a long-term disability denial to speak to a disability lawyer. The appeals process is rarely successful and typically wastes a claimant’s time. Claimants have two years after the initial denial of disability benefits to file a legal claim and pursue their rights. Appeals are not conducted by a third-party arbitrator and are often overseen by the adjuster that initially denied the claim.
- Medical professionals’ uncertainty to join the legal process: Most medical professionals are concerned with helping their patients that have difficulty with their insurance companies, particularly those coping with a mental illness. Some treating doctors do not believe that claimants are disabled from working. Claimants with doctors who do believe they should be on LTD can seek advice from a disability lawyer on the importance of details provided to the insurance company.
- Claimant sent to insurer recommended psychiatrist: Most disability policies require claimants to attend an independent medical examination if requested by the insurance company. Claimants are not obligated to receive treatment from a medical professional recommended by the insurer.
