Key points on overtime pay
- Who is eligible: Non-unionized salaried and hourly employees are entitled to overtime pay, while most managers are not.
- Don’t accept unpaid overtime: If you’re not being paid for overtime, you may have a claim for constructive dismissal and be entitled to severance pay.
- Termination and owed overtime: Our employment lawyers can pursue your full severance package – as much as 24 months’ pay – along with any overtime pay that your employer still owes you.
- Unionized employees: If you belong to a union, the rules about overtime pay will be outlined in your collective bargaining agreement.
