Employers can use artificial intelligence at work, restrict how employees use AI tools and restructure jobs because of AI. But AI does not erase your employment rights.

If you are fired, disciplined, monitored or replaced because of artificial intelligence, your employer must still follow employment standards, human rights laws, your employment contract and other workplace rules that apply to you.

Samfiru Tumarkin LLP helps non-unionized employees in Ontario, Alberta and British Columbia understand their rights when AI changes their job or leads to termination.

⚠️ Fired or replaced because of AI?
Your employer can eliminate your position, but that does not eliminate your severance rights. Don’t sign a termination package before finding out what you are owed.

What Are Your Rights When AI Is Used at Work?

AI can change how work is performed, but existing employment laws still apply.

Employers may use artificial intelligence for tasks such as:

  • automating work
  • screening job applicants
  • tracking productivity
  • reviewing employee performance
  • creating schedules or recommendations
  • restructuring positions

The use of AI does not allow an employer to ignore severance obligations, discriminate against employees or make major changes to employment terms without legal consequences.

Can You Be Fired or Replaced by AI?

Yes. An employer can eliminate a position because technology or AI has reduced the need for the work.

For a non-unionized employee, the key issue is usually not whether the employer was allowed to automate the job. It is whether the employee received the full severance package they are legally owed. That amount can be as much as 24 months’ pay.

Severance can depend on factors such as:

  • age
  • length of service
  • position
  • compensation
  • employment contract
  • the availability of comparable work

Read our guide to severance pay in Canada or use the Severance Pay Calculator.

💡 “Your job was automated” is not a reason to accept less severance.
Technology may explain why the employer eliminated your position. It does not determine how much compensation you are owed.

What if AI only replaces part of your job?

An employer can change duties as technology changes. But a substantial unilateral change to your role, responsibilities, status or compensation can raise constructive dismissal concerns.

Can Your Employer Ban AI or ChatGPT at Work?

Yes. Employers can set workplace rules restricting or banning the use of AI tools.

A policy may restrict employees from entering company information into public AI tools, using AI to prepare confidential documents or relying on AI for work that requires human review.

Employees should pay particular attention to rules involving:

  • confidential company information
  • client or customer data
  • personal information
  • copyrighted or proprietary material
  • work that must be independently verified

If your employer introduces a new AI policy, read it carefully and ask for clarification if the rules are unclear.

Can You Be Fired for Using AI at Work?

Yes. Misusing AI can lead to discipline or termination. But that does not automatically mean your employer has just cause to fire you without severance.

The seriousness of the situation can depend on:

  • whether the employer had a clear AI policy
  • whether you were warned
  • what information you entered into the AI tool
  • whether confidentiality or privacy was compromised
  • whether the work contained inaccurate or fabricated information
  • your employment history and the seriousness of the incident

⚠️ Fired “for cause” over AI use?
Don’t assume you have lost your severance. An employer must meet a high legal threshold to terminate a non-unionized employee for cause without compensation. Have the allegation reviewed before signing anything.

Can Your Employer Use AI to Monitor You?

Employers can use technology to monitor workplace activity, but privacy, transparency and employment-law rules can apply.

AI-enabled monitoring can include:

  • productivity tracking
  • keystroke or activity monitoring
  • reviewing communications
  • tracking websites or applications used
  • automated performance scoring

In Ontario, employers with 25 or more employees must maintain a written electronic-monitoring policy explaining whether employees are monitored, how monitoring occurs and how the information may be used. The rule requires transparency; it does not create a general right to refuse workplace monitoring.

Other privacy laws can also affect how employee information is collected, used and stored, particularly in federally regulated workplaces and in provinces with private-sector privacy legislation.

Can Employers Use AI to Make Hiring or Workplace Decisions?

Yes, but employers remain responsible for employment decisions made with the help of AI.

AI does not give an employer permission to discriminate based on disability, age, race, sex, religion or another protected characteristic.

If an AI-based system produces a discriminatory result, human rights laws can still apply.

💡 Ontario job seekers now receive additional AI transparency.
Since January 1, 2026, covered employers must disclose in publicly advertised job postings when they use artificial intelligence to screen, assess or select applicants.

AI at Work: FAQs

Can your employer replace you with AI?

Yes. An employer can eliminate a position because of automation or artificial intelligence, but it must still provide the termination notice or severance the employee is owed.

Can you be fired for using ChatGPT at work?

Yes. An employer can discipline employees who violate workplace policies or misuse confidential information. Whether the conduct justifies termination without severance depends on the facts.

Can your employer make you use AI?

Employers can introduce new tools and reasonable work processes. A major change to your position, responsibilities, compensation or other fundamental employment terms can raise constructive dismissal concerns.

Can your employer monitor your AI use?

Yes. Employers can monitor work systems and tools, subject to the privacy and transparency rules that apply to the workplace.

What if AI wrongly flags your performance?

Ask the employer to explain the concern and provide the underlying facts. An automated score does not prevent you from challenging inaccurate allegations, discipline or a termination decision.

Can AI be used to decide who gets laid off?

Employers can use technology when making restructuring decisions, but the final decision still has to comply with employment and human rights laws. If you are terminated, your severance rights remain.

What if you’re unionized?

Your collective agreement may contain rules about technology, job changes, monitoring, layoffs and discipline. Contact your union. Samfiru Tumarkin LLP’s employment law team does not assist with unionized workplace disputes.
