Ontario to Ban Most Employers from Charging Staff for Mandatory Uniforms

Is a Uniform Charge Allowed in Ontario?

Currently, yes. However, the Ontario government is looking to update the province’s Employment Standards Act (ESA) to prevent most employers from requiring workers to pay for mandatory uniforms or deducting those costs from their wages.

“Ontario workers are the backbone of our province and they deserve to keep more of what they earn,” David Piccini, Minister of Labour, Immigration, Training and Skills Development, said in a news release.

“Whether you work in [entry-level sectors like retail, hospitality, or food service], no one should have to pay out of pocket for a uniform just to earn a paycheque.”

While the cost range of uniforms can differ, some Ontarians are required to spend upwards of $50 on branded apparel or company-required equipment.

Will There be Exemptions?

Yes. If the uniform charge ban is passed, the Ministry of Labour claims that it will “consult on certain exemptions.”

  • Example: A small business might be allowed to charge staff for a mandatory uniform.

The proposed change is part of a broader package of measures that the Ontario government is hoping to implement.

Additionally, the province is looking to establish the Strengthening Talent Agency Regulation (STAR) Act to enhance transparency and oversight of payments handled by talent agencies in the entertainment industry.
