- Approved disability for own occupation: It is not up to the individual after the first two years on long-term disability, to prove they are unable to work in any occupation. Insurers often deny claimants benefits as the change in definition period occurs and insist claimants can work in a sedentary position. Insurers should listen to their own treating doctors about their abilities and limitations.
- Condition worsening after short-term disability: Some conditions, such as epilepsy, if well controlled might disqualify claimants from long-term disability. However, some conditions can cause secondary symptoms and ailments. It is important to apply for long-term disability if still unable to work at the end of short-term disability benefits. It is vital for claimants to ask their doctors for specific limitations in regard to their disability.
- Position filled after disability leave: In some claims, employment and disability issues can intersect and overlap. It is vital to seek legal advice from a lawyer well-versed in both employment and disability law. Employees cannot be terminated as a result of taking medical or disability leave. Employers have a duty to accommodate employees with medical conditions.
- Serious injury after a bicycle accident: After a collision occurs in which an individual is at fault, it is vital for the injured party to speak to a personal injury lawyer.
