- Disability benefits cut off despite numerous health conditions: Many claimants experience a cut off from disability benefits after the first two years. An indicator that an insurance company is preparing to end benefits can be a request to attend a functional abilities assessment. A functional capacity evaluation can be used by the insurer to pressure a claimant back to work and end benefits.
- Not continuously considered disabled: It is important for claimants that have been denied long-term disability benefits to speak with their treating doctors. The elimination period is the time period before disability benefits begin. The insurance company looks to determine that a claimant has remained disabled from their own occupation during the elimination period.
- The situation at work aggravated my mental health condition: In the event, a workplace stressor contributes to a health condition, insurance adjusters often deny claims that a disability is in fact just a workplace condition. Often, a stressful or toxic work environment can lead to a generalized health condition. It is important for claimants to determine whether or not they have ongoing functional limitations and speak to their treating doctors.
- Union members and disability claim: Union members should determine the specifics of their collective agreement. In many cases, a union member is able to pursue legal advice from a disability lawyer.
