- On LTD but policy has pension provision: In some disability policies, provisions can entail that as soon as pension payments begin, long-term disability payments will end. Insurance adjusters can pre-emptively cut off benefits or end LTD before other benefits commence. It is important for claimants not to assume that the insurance company is right to cut off benefits and if unsure about the terms outlined in their LTD policy, seek legal advice from a disability lawyer.
- Seizure disorder prevents an inability to perform job duties: It is important for individuals to understand that a diagnosis is not necessary in order to receive long-term disability benefits. Any illness or injury that prevents a claimant from performing the essential tasks of their own occupation is considered a disability. Claimants often mistakenly believe that ‘total disability’ means a complete disability and inability to function day-to-day.
- Professionals are necessary to provide medical evidence for claims: Many treatment providers do not want to be involved in the legal process when filing a disability claim. It is not common for more than minimal participation to be required for treatment providers throughout the legal process. It is important for treating doctors and a medical team to provide support for claimants and ensure that all documentation is up-to-date and detailed.
