Foodora Couriers, Right to Unionize and Employment Rights – CBC News
The Ontario Labour Relations Board (OLRB) has found that Foodora couriers are dependent contractors. This decision clears the way for the couriers to form a union, and sets a precedent for the gig economy in Canada.
Jon Pinkus, employment lawyer and Partner at Samfiru Tumarkin LLP, spoke to Greg Ross on CBC Toronto News about the ruling. He explains why the OLRB’s decision to classify Foodora couriers as dependent contractors only strengths his law firm’s argument that Uber drivers are in fact employees and not independent contractors in Ontario.
Samfiru Tumarkin LLP filed a class action lawsuit against Uber Technologies Inc. on behalf of thousands of Uber drivers in Ontario. The case was recently heard before the Supreme Court of Canada.
