What We Covered

Unfair terminations, temporary layoffs, bonuses, forced resignations, what to do when your employer stops paying for mileage, how to negotiate a severance package and MORE on The Employment Hour on Global News Radio 640 Toronto and 980 CFPL in London.

Chapter 1:

Should I negotiate my own severance package?

The week that was, Jon discusses a previous case where his client worked as a sales agent and made a commission on his salary.  When the company decided to restructure and terminate his position he attempted to negotiate the termination contract on his own.

Chapter 2:

How to determine if you are really an independent contractor.

Jon discusses a client who worked as an “independent contractor” for a company under stable employment for 10 years.  When the company had financial difficulties and ended her contract they tried to offer her only 2 weeks pay per her original employment agreement.

Chapter 3:

Can your employer decide to stop paying mileage for travel?

I have worked as a sales representative for over 10 years with my current employer.  Recently a new manager has told us we can no longer bill for mileage while driving to meet clients.  Am I entitled to receive mileage for driving to client meetings?

Chapter 4:

What can I do if my employer tries to force me to resign?

My friend is 51 years old and is an operational supervisor.  The company decided to restructure her department and were hoping to force her to resign.  They promised her another position instead if she resigned from her current one.  She received her letter of resignation and had a meeting to raise her concerns over it and was then terminated for willful misconduct.

Chapter 5:

What can I do to appeal an unfair termination?

My sister was recently terminated with cause.  She is partially deaf and partially blind and filed a grievance against her employer due to lack of accommodation.  Her claim is with the human rights tribunal, but she is trying to appeal her termination with her workplace.

Chapter 6:

Is the exclusion of common law severance remedies valid in an employment contract?

If so, why don’t all employers include these in their employment contracts?

Chapter 7:

What are my entitlements if I was terminated while on temporary layoff from my position?

I worked for 22 years as a mechanical engineer and was laid off for 8 months.  During this time the company was sold and my position was terminated.  I was offered 2 months of severance.

Chapter 8:

Am I entitled to severance as a long-term part-time employee?

I have worked 1 day a week for 20 years for one company as a contractor.

Chapter 9:

Is getting into an argument with a coworker grounds for just cause dismissal?

Chapter 10:

Who pays for legal fees in employment law cases?

Chapter 11:

Do severance packages include bonuses?
