Summary

Canadian Employment Lawyer Lior Samfiru, founding partner at Samfiru Tumarkin LLP, reveals your workplace rights in Toronto, the surrounding GTA, Hamilton, London and across Ontario. Lior shatters myths and misconceptions about severance pay, terminations, workplace harassment, overtime pay, wrongful dismissal, constructive dismissal, duty to accommodate, and more.

What We Covered

WEEK THAT WAS #1: A single mother asked her employer to allow her to work from home to accommodate her son’s medical condition. Her employer refused. Does the company have a duty to accommodate her family obligation?

WEEK THAT WAS #2: Should I file a severance complaint with the Ministry of Labour? Lior explains how doing so cost a 20-year employee his full severance after a “for cause” termination.

CALLER: A friend of mine just discovered that a job they performed was actually illegal. What should you do if your employer asks you to do something illegal?

Can I be fired for standing up for my legal rights?

CALLER: After 25 years, my company was bought by a new owner. I was fired and given two weeks’ pay after refusing to sign a new employment agreement. What should I do?

CALLER: A senior manager has asked to work for another company for 1 day a week, for 2 years. The company isn’t a competitor. Should we agree to this arrangement?

CALLER: My employer is closing down. They keep changing the working notice period. They have also refused to observe common law severance packages.

CALLER: A potential new employer has offered me an employment contract that says they can let me go without severance during a 6-month probation period. Is that legal?

CALLER: My employer continues reducing my hours over a 6-month period. Can I argue claim constructive dismissal?

CALLER: How far can you go back for severance pay after you’ve been dismissed from a job?

CALLER: My son was fired one month into his job after noting a poor work ethic and workplace safety issues. Is he owed anything?

CALLER: My friend is a part-time dental hygienist. Her company was sold. The new owners want to reduce her hours. If they decide not to keep her, do they have to pay severance for previous years’s service? Lior explains how severance works for dental hygienists.

CALLER: After 20 years, my employer is going to start paying commission at the end of the year. Can they do that?

CALLER: My wife was fired one month after complaining about sexual harassment, and suffering a workplace injury. This happened 3 years ago.
