Summary

Canadian Employment Lawyer Lior Samfiru, Partner at Samfiru Tumarkin LLP, reveals your workplace rights in Ontario, and shatters myths and misconceptions about severance pay, terminations, workplace harassment, overtime pay, wrongful dismissal, constructive dismissal, duty to accommodate, and more.

What We Covered

– WEEK THAT WAS #1: An employee who provided his employer with a doctor’s note from a walk-in clinic was told that the note wasn’t valid. Is a doctor’s note from a walk-in clinic valid? Do I need to tell my employer what my medical condition is?

– WEEK THAT WAS #2: An employee who always worked Monday to Friday was asked to start working weekends. He refused. The company treated his refusal as a resignation. Lior explains why this is a termination with severance pay.

– CALLER: I’ve been with the same company for 16 years. I want to switch to part-time employment. Is my employer required to accommodate my switch to part-time work

– CALLER: I have been at the company for 10 years. I suffer from carpal tunnel syndrome, and can’t perform the same work duties as in the past. My employer does not want to accommodate me. What should I do?

– CALLER: I’m a sales rep. Every year, my employer asks us to sign a new contract that sets our targets and commissions. If we don’t sign it, we are deemed to have quit. We’re employees, but they are calling us independent contractors.

– CALLER: My wife is a salaried employee. Sometimes she works over 40 hours per week. Her employer says she’s not entitled to overtime pay. Is she owed any overtime pay

– CALLER: I was dismissed without cause on a Wednesday, and told to sign a severance offer by Friday. How do companies get away with forcing terminated employees to accept poor severance packages?

– CALLER: If I resign from a company after 10 years, but return to the company under recognition of previous employment, will my severance pay include the previous 10 years

– CALLER: My wife has been working at a software development company for 7 years. She is on a maternity leave right now, but will return to work in 3 months. However, her employer is firing many of her coworkers. How much severance pay would she be owed?

– CALLER: Can a company legally offer you a larger severance package on a payment plan (salary continuance) compared to a smaller lump sum amount?

– CALLER: I have been offered a job with the new owner of our company. If I don’t accept the job, I will be offered a severance package. What should I do?

– CALLER: What happens if somebody gives their two weeks’ notice, but their employer tells them not to return to work at all?
