  • Age and disability policies: Most disability policies can offer claimants coverage up to the age of 65. Insurance companies will look at the specifics of certain conditions as well as the type of job a claimant is employed in to determine premiums. Claimants that are early in their careers and are relatively young can face difficulty receiving long-term disabilty claimants. Insurers do not necessarily want to offer benefits for claimants that will be on a claim for many years.
  • LTD benefits and employment benefits package: Most long-term disability policies will cover a claimant’s base salary, this can at times exclude commissions and bonuses. It is important for claimants to look closely at the terms outlined in a disability group policy. Claimants should speak to their employers as to what coverage they will be given.
  • Offered lump-sum by insurance provider: Insurance companies can offer claimants a one-time settlement or lump sum early on in their claim. Insurers typically offer lump sums to claimants that could be on a claim for many years. Before accepting the insurance company’s offer, claimants should seek legal advice from a disability lawyer. Claimants are within their rights to refuse a settlement and speak to their doctors about their prognosis and ability to work in another occupation.
  • Employment terminated while on LTD: A termination of employment while on a long-term disability claim does not mean an end to benefits. In order to receive disability benefits, claimants must be employed at the time of their approval for LTD. Employers are only able to pursue a frustration of contract if provided with necessary medical information that confirms a claimant will not be able to work.
