  • Multiple appeals but denied long-term disability due to form issues: It is important to remember that the appeals process was created by insurance companies in order to keep the power and influence with their company and not the claimant. It is recommended that claimants file a legal claim if they are unable to work but have been denied benefits.
  • Denied LTD as the claimant can do daily activities despite neurological condition: Insurance companies in some instances will choose to focus on the abilities a claimant does still have. It is important to determine the functionality of a claimant and what they are able to do and the severity of the disability. While there can be objective medical evidence, it is important for doctors to specify how a claimant is unable to work and the limits to their abilities in a detailed report for the insurer.
  • Disability benefits are typically part of a group disability plan by an employer: In the event that a disability claim has been denied, many claimants believe that their employer had a say in the denial. This is typically untrue and inaccurate. An employer does pay the premium and is informed of a claim’s approval or denial as well as answers some questions from the insurance adjuster regarding the employee’s reliability and performance.
  • Definition of disability for benefits and claimants: It is important when applying for long-term disability for claimants to look closely at their disability policies and determine the specific language included and how to receive approval or a reason for denial. Claimants should not give up their rights and can ask their insurer for a copy of their policy.
