  • Let go from a job due to performance and denied LTD: Most disability policies stipulate claimants should be employed and working at the time of their long-term disability application. Claimants are still able to apply for disabilty benefits and should receive approval if they became disabled while still employed. It is important to seek legal advice from disability lawyers aware that employment and disability issues can overlap.
  • Chronic pain definition and disability benefits: Chronic pain can be any kind of pain that persists for longer than six months and interferes with a claimant’s ability to work. Insurance companies often deny claims regarding chronic pain however, claimants should not give up their rights to benefits. Many chronic pain conditions are considered invisible illnesses due to a lack of objective medical evidence.
  • COVID-19 long-haul symptoms but denied LTD: Many individuals continue to experience symptoms long after contracting COVID-19. Claims are denied by insurance adjusters for a variety of reasons, but this possibility should not dissuade claimants from applying for LTD. Claimants with the support of their treating doctor should still apply for disability benefits.
  • On LTD due to arthritis told to apply for CPPD: Most long-term disability policies contain provisions that require claimants to apply for CPP Disability. It is beneficial for claimants to apply for CPPD as the test in order to qualify for benefits is more severe than that of LTD. An approval for CPPD can strengthen an LTD claim.
