  • Approval for CPP Disability but did not inform LTD insurer: Many disability policies stipulate contain a provision that stipulates that if claimants receive CPP Disability, the insurance company will receive a credit. It is important to be open and honest with the insurance company about any other sources of benefits and income.
  • Denied LTD despite PTSD due to possible pre-existing clause: Insurance company adjusters often refer to a “twenty-four-month clause” that often confuses and misleads claimants. A pre-existing condition is a contractual term and does not simply mean a condition that a claimant has had in the past. The terms and provisions in long-term disability policies can be difficult to decipher and claimants that are unsure of the terminology should speak to a disability lawyer for clarification.
  • On LTD due to severe arthritis but had to leave due to family issues: Individuals that are suffering from severe conditions that can be considered disabling, such as osteoarthritis and AFIB, often question whether or not they are able to travel while on LTD. Claimants should look closely at their LTD policies to determine if there are limits to travelling. Individuals that are forced to travel should ensure that they are maintaining treatments.
