⭐⭐⭐⭐⭐ ⭐⭐⭐⭐⭐ During the pandemic I was put on a extended lay off while I was covid positive, and without going into details it was absolutely a constructive dismissal and the temp lay off for 7 months was a solution that many employers used to get away with it. I had researched my rights within my 6 month period with human rights and employment standards but because Covid-19 was such a unique event to many of us, it wasn’t even written into laws yet at that time and with jobs being so scarce many were hopeful to get their jobs back even if it meant working for companies that took advantage. With fear of pursuing action I waited until I was served the permanent lay off and kept hearing all the radio ads as I was upset, and couldn’t find work, many of us dealt with Cerb repayments, and other taxation issues, many are still dealing with it. I reached out to Samfiru Tumarkin to seek my rights and even though I was not an employee for long, nor could I pursue a constructive dismissal what many people don’t know is that we do have rights based on the industry you are in, your age and many other factors to argue proper notice. I am so happy I pursued this , stayed with it and stayed strong. I dealt with Karen Tereposky, whom was direct, kept me in line to what was relevant. She was amazing to deal with during the entire process, with clear communication, follow ups and advice. We reached a settlement that was rare in my circumstance and I am just so happy with the overall outcome. Do not hesitate to just ask, and know your rights. Be patient, be strong and just do it.
