How does severance pay work?

When you are fired, laid off or lose your job in Ontario, the law requires your employer to give you an appropriate severance package.

For non-unionized employees, a complete severance package in Ontario (and across Canada) is determined by reviewing the person’s age, time spent at the company, position, bonus and benefits, among other things. The full amount can total as much as 24 months’ pay.

What is a wrongful dismissal?

A wrongful dismissal in Ontario happens when you are let go from your job without the proper amount of severance pay. Often times, the difference between what you are offered by the company and what the law says you should receive can be tens of thousands of dollars!

A fair severance package can be as high as two years’ pay. Multiple factors come together to determine that amount including:

  • How old you are
  • How long you worked for the company
  • What your position was
  • How easy it is to find new work

Can my employer make changes to my job?

No. It is generally illegal for an Ontario employer to make major changes to your employment. This applies to things like pay cuts, schedule changes, your job title or duties, bonus pay, or work location.

If your job is significantly altered without your consent, your employer is effectively terminating your employment. You are owed full severance – as much as 24 months’ pay, through a constructive dismissal claim. Can I be fired if my Long-term Disability Claim is denied?

It is completely illegal for your employer to fire you because your short- or long-term disability claim has been denied or cut off by your insurance provider in Ontario (or any other Canadian province).

Your employer can’t let you go because of your disability or medical situation. Furthermore, the insurance company can’t refuse you disability benefits if your doctor says you legitimately can’t work due to illness or injury.
