A termination without cause lawyer in Toronto reviews your dismissal, calculates the full compensation you are owed and deals with your employer before you sign away your rights.

If your employer ended your job without cause, you are entitled to proper notice or compensation. The amount in your termination letter is not automatically your full entitlement. For many non-unionized employees, proper severance is substantially greater than the minimum required by Ontario employment standards legislation.

Samfiru Tumarkin LLP’s Toronto employment lawyers help employees determine what their termination is actually worth, identify problems with severance offers and negotiate improved packages when more compensation is owed.

⚠️ Don’t sign a severance package or release before it has been reviewed. Once you sign a release, you usually can’t go back and demand additional compensation.

When Should You Call a Termination Without Cause Lawyer in Toronto?

Contact a termination lawyer before you accept your employer’s severance offer or sign a release.

You should have your termination reviewed if:

  • You were told your employment is ending “without cause”
  • Your position was eliminated during restructuring or downsizing
  • Your employer offered only a few weeks of pay
  • You were given a short deadline to sign a severance package
  • Your package excludes bonuses, commissions, benefits or other compensation
  • Your employer says your employment contract limits what you can receive
  • You were terminated during or after a medical leave, parental leave or accommodation request
  • You aren’t sure whether the severance offer is fair

You don’t need to wait until a dispute develops. Getting advice before you respond to the package gives you the opportunity to understand your rights while your options are still open.

How Can a Toronto Termination Without Cause Lawyer Help?

A termination lawyer determines whether your employer’s offer reflects your full legal entitlement and takes the appropriate steps to pursue more when it doesn’t.

Our Toronto employment lawyers can:

  • Review your termination letter. We identify what your employer is offering and what conditions are attached to the payment.
  • Review your employment contract. We determine whether a termination clause affects your common-law rights and whether the clause is legally enforceable.
  • Calculate your full severance entitlement. We assess your age, service, position, compensation and prospects for comparable employment.
  • Identify missing compensation. Salary is only one part of a termination package. Bonuses, commissions, benefits and other compensation can also matter.
  • Negotiate with your employer. If the package is inadequate, we can present your legal position and negotiate for the compensation you are owed.
  • Pursue a wrongful dismissal claim when necessary. If a fair resolution can’t be reached through negotiation, we can advise you about the next legal steps.

Most importantly, you get an answer to the question that matters: Should I sign this package, negotiate it or pursue a claim?

How Much Severance Are You Owed After a Without-Cause Termination?

There is no automatic “one week per year” severance rule for non-unionized employees in Toronto.

Ontario’s Employment Standards Act creates minimum termination rights. Those minimums are important, but they are not necessarily your full entitlement.

Unless an enforceable employment contract validly limits your rights, common-law reasonable notice can provide substantially more compensation. The amount is assessed using factors that include:

  • Your age
  • Your length of service
  • Your position and level of responsibility
  • The availability of comparable employment

These are commonly known as the Bardal factors.

Depending on factors such as age, position, length of service and the availability of similar employment, severance can reach 24 months’ pay.

💡 The ESA sets minimum rights. It does not automatically determine your full severance entitlement. Don’t measure your package against the government minimum and assume the calculation is finished.

For a complete breakdown, see our guide to severance pay in Ontario. If your main concern is the amount or structure of your package, our Toronto severance pay lawyers can review it with you.

What Does a Termination Lawyer Review?

A proper termination review looks beyond the number of weeks written in your severance letter.

Your employment contract

Your contract can have a major effect on your entitlement. Employers frequently rely on termination clauses to limit severance, but signing a contract does not automatically make every clause enforceable.

We review the language against current Ontario law and determine whether it actually limits your common-law rights. Learn more about employment contracts in Ontario.

Your complete compensation

Your termination package isn’t necessarily limited to base salary. Depending on your compensation structure and legal rights, the calculation can also involve:

  • Bonuses
  • Commissions
  • Benefits
  • Pension or retirement contributions
  • Allowances and other compensation

Whether the dismissal creates another legal claim

Being terminated without cause is usually legal if proper notice or compensation is provided. But an employer can’t dismiss you for a prohibited reason.

If the termination was connected to disability, pregnancy, family status, age or another protected characteristic, there can be human rights issues in addition to severance. See our guide to workplace discrimination in Ontario.

A without-cause dismissal can also become a wrongful dismissal when your employer fails to provide sufficient notice or compensation.

What Happens After You Contact a Toronto Termination Lawyer?

The process starts by determining what happened, what you were offered and what you are actually owed.

Before speaking with a lawyer, gather the documents you already have. Useful records include:

  • Your termination letter and severance package
  • Your employment contract and later amendments
  • Recent pay statements
  • Bonus or commission plans
  • Benefits information
  • Relevant emails or correspondence about the termination

We can then assess your termination, explain your options and tell you whether the package should be accepted or challenged.

If more compensation is owed, the next step is often negotiation. You can learn more about negotiating a severance package in Ontario.

If your employer won’t provide proper compensation, our wrongful dismissal lawyers in Toronto can advise you about pursuing the claim further.

⚠️ Your employer’s signing deadline is not your legal deadline. A demand that you sign within a few days does not erase your right to proper severance. A civil wrongful dismissal claim is generally subject to a two-year limitation period in Ontario, but other claims can have different deadlines. Get advice before signing a release.

Termination Without Cause Lawyer Toronto: Frequently Asked Questions

Do I need a lawyer if I was fired without cause?

You should have the termination package reviewed before signing if you don’t know whether the offer reflects your full legal entitlement. A lawyer can assess your contract, compensation and common-law rights and tell you whether negotiating the offer makes financial sense.

Can my employer fire me without giving a reason in Toronto?

Yes. An Ontario employer can usually end a non-unionized employee’s employment without cause without proving misconduct, provided the employer gives the required notice or compensation and the dismissal is not discriminatory, retaliatory or otherwise prohibited.

Can I negotiate a without-cause severance package?

Yes. Your employer’s first offer does not determine your full entitlement. If the package is too low, you can negotiate for additional compensation before signing the release.

What if my employer only offered ESA minimums?

Don’t assume the ESA minimum is all you are owed. Many non-unionized employees have greater common-law rights unless an enforceable employment contract validly limits those rights.

What if my employer says my contract limits my severance?

Have the termination clause reviewed. The fact that a contract contains a termination clause does not automatically mean the clause is enforceable. If the clause fails, your entitlement can be significantly greater.

What is the difference between a termination lawyer and a severance lawyer?

The services often overlap. A termination-without-cause lawyer reviews the entire dismissal, including the legal reason for termination, your contract and the compensation offered. A severance lawyer focuses more specifically on calculating, reviewing and negotiating the termination package.

⚠️ Unionized? You need to challenge your termination through your union and the grievance process. Our employment law team can’t assist with unionized workplace disputes.

If you’ve been terminated without cause in Toronto, don’t assume your employer’s package represents everything you are owed. The amount can change significantly once your employment contract, compensation and common-law rights are properly assessed.

Get the package reviewed before you sign it. Samfiru Tumarkin LLP’s Toronto employment lawyers can determine what you are owed and help you take the right next step.
