- Referred to a psychologist but still unable to work: Claimants who are unable to work due to a disability and have the support of their doctors should receive long-term disability benefits approval. Individuals with mental health claims are often denied disability benefits but should speak to a disability lawyer before giving up on their rights.
- Pedestrians involved in a car accident: Individuals involved in a car accident must document and report the incident. Many people involved in car accidents are unaware they are eligible for Section B benefits for treatment. Treatment benefits are accessible through an individual’s own vehicle insurance or the at-fault party’s insurance. A claim for benefits must be made within 30 days of the accident.
- Section B benefits after an accident: Section B benefits are accident benefits and are accessible regardless of who is deemed at fault. Section B benefits can include medical benefits, as well as disability benefits if an individual is unable to work as a result of their injuries.
- Diagnosed with arthritis and on LTD: An insurance adjuster cannot force a claimant to return to work. Claimants should continue to listen to the advice from their medical team and treating doctor. Returning to work before medical clearance is given can result in a further deterioration of health.
