As the pandemic continues and case counts continue to rise across the province, booster doses of the COVID-19 vaccine are slowly becoming available. For workplaces that already have a vaccine mandate in place, will they eventually include a booster dose? What will this mean for employee rights?
A Toronto employment lawyer at Samfiru Tumarkin LLP spoke with the Toronto Star regarding booster doses and employee rights.
“If a workplace vaccine policy didn’t include a clause which allowed for changes to the definition of fully vaccinated, employers would have a harder time changing it,” says the employment lawyer.

Fired for refusing a booster dose
The lawyer states employers should have taken note of the possibility of booster doses at the outset of drafting vaccine policies. “Employers who have been introducing policies, to begin with, ought to have considered including boosters in the future. Or … built-in language that provides for ongoing modifications as things progress, Given that the COVID situation is changing on a seemingly daily basis,” the lawyer explains.
