Show Notes

  •  A long-service employee given inadequate severance: Employees are owed severance based on a number of factors, including their age, years of service and position. Employers typically impose a deadline for employees to accept their initial severance offer as a pressure tactic. Rights to severance do not expire until two years after the date of termination.
  • Accepting a temporary layoff: Many employees were placed on a temporary layoff as a result of the pandemic. Regardless of the circumstance, most employers do not have the right to place employees on a temporary layoff. Employees who choose to accept a layoff have given their employer the right to impose another layoff in the future. Layoffs can be refused by employees and treated as a termination of employment.
  • Employer declares bankruptcy to avoid severance: It is not a simple solution for employers to declare bankruptcy. Bankruptcy declarations must be legitimate in order to avoid paying employees severance entitlements. Employees should not agree to an initial offer of severance before contacting an employment lawyer.
